Terms of Service

Its1Ticket is a digital ticketing, box-office, and event-registration platform operated by Its One App, LLC. These Terms of Service (the “Terms”) govern your access to and use of the platform, whether you are an organization hosting and selling tickets to events (an “Organizer”) or an individual purchasing or receiving tickets (a “Buyer”). By accessing or using the Service, you agree to these Terms. Please read them carefully.
1. Use of the Service
Its One App, LLC provides a digital platform for creating events, selling and scanning tickets, operating a box office, collecting event registration information, and receiving payouts (the "Service"). Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.
You agree to use the Service only for lawful purposes and not to misuse it or help anyone else do so. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. Accounts and Security
You must provide accurate, complete, and current information when creating an account and keep it up to date. You are responsible for safeguarding your account credentials and for all activity under your account, and you agree to notify us promptly of any unauthorized use.
3. Organizer Responsibilities
If you use the Service to host events and sell tickets (an "Organizer"), you are solely responsible for your events, the accuracy of your event and pricing information, your compliance with applicable laws, and any information you choose to collect from buyers (including through custom registration fields).
- •You control what data you collect and must have a lawful basis, and any required notices or consents, to collect it.
- •You are responsible for your relationship with your attendees, including honoring the tickets you sell and responding to their requests.
- •You must connect a valid payment account to receive payouts and are responsible for the tax treatment of your sales.
4. Tickets and Buyers
A ticket is a limited license to attend the applicable event, granted by the Organizer and subject to the Organizer’s rules. Its One App, LLC provides the technology that issues and validates tickets but is not the host of, and is not responsible for, the events themselves.
Buyers are responsible for providing accurate purchase information and for the security of the tickets they receive. Duplicate, altered, or fraudulently obtained tickets may be voided.
5. Payments, Fees, and Payouts
Payments are processed by our third-party payment processor (Stripe). By transacting through the Service, you agree to the payment processor’s terms. Its One App, LLC does not store full payment card numbers.
We charge a per-ticket platform fee, disclosed at the point of sale or in your Organizer settings. Organizer proceeds, net of platform and processing costs, are paid out to the Organizer’s connected payment account on the processor’s settlement schedule. Organizers are responsible for any applicable taxes on their sales, and chargebacks, disputes, and refunds may be deducted from Organizer proceeds.
6. Refunds and Cancellations
Refund and cancellation policies for an event are set and administered by the Organizer, and buyers should review them before purchasing. Unless required by law or the Organizer’s stated policy, sales are final.
If an event is canceled or materially changed, the Organizer is responsible for handling refunds. Platform and processing fees may be non-refundable.
7. Content and Data
The Service allows you to submit content and data, including event details and registration information. You are responsible for the accuracy and appropriateness of what you submit and must have the right to submit it.
You retain all rights to your content. You grant Its One App, LLC a limited license to host, store, and process it solely to operate and provide the Service. You may request export or deletion of your data as described in our Privacy Policy and Data Management page.
8. Student Data and Additional Agreements
When an Organizer is a school, school district, or other educational agency or institution (an "LEA") and uses the Service to process student information, the parties will enter into our FERPA Data Privacy Addendum (the "DPA"), which is incorporated into these Terms by reference for such Organizers.
For any conflict between these Terms and the DPA with respect to student education records or other Student Data (as defined in the DPA), the DPA controls. Organizers may request the DPA at privacy@its1app.com or via our FERPA page.
Any other separate written agreement executed between you and Its One App, LLC (such as an order form or enterprise agreement) also supplements these Terms and, where it expressly so states, takes precedence.
9. Acceptable Use
- •Do not use the Service to violate any law or the rights of others.
- •Do not attempt to gain unauthorized access to the Service, other accounts, or related systems.
- •Do not interfere with or disrupt the integrity or performance of the Service.
- •Do not resell, scrape, or otherwise misuse tickets or platform data.
10. Intellectual Property
The Service and its original content (excluding content you provide), features, and functionality are and will remain the exclusive property of Its One App, LLC and its licensors, and are protected by copyright, trademark, and other laws.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access for a material breach of these Terms, unlawful use, or a risk to the Service or others.
For paid Organizer accounts, except where immediate action is needed to prevent harm, fraud, or a legal violation, we will provide reasonable prior notice before terminating and a reasonable opportunity to export data. Upon termination, your right to use the Service ends, and data handling for LEAs follows the return-and-destruction terms of the DPA.
12. Disclaimers and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
To the maximum extent permitted by law, Its One App, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of or inability to use the Service. For Organizers that are LEAs, liability and indemnification with respect to Student Data are governed by the DPA, which controls over this section.
13. Indemnification
You agree to indemnify and hold harmless Its One App, LLC from claims arising out of your events, your content, your collection or use of attendee data, or your breach of these Terms, except to the extent caused by Its One App, LLC. For LEAs, the indemnification terms of the DPA govern with respect to Student Data.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and the exclusive venue for disputes lies in the state or federal courts located in Potter County, Texas, except where the DPA provides otherwise for Student Data claims. Our failure to enforce any provision is not a waiver of it.
15. Changes to These Terms
We may modify these Terms from time to time. If a change is material, we will provide at least 30 days’ notice before it takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
16. Entire Agreement
These Terms, together with our Privacy Policy and, for LEAs, the FERPA Data Privacy Addendum, constitute the entire agreement between you and Its One App, LLC regarding the Service and supersede prior agreements on that subject.
